Kurz má za cíl seznámit studenty s jedním z nejnovějších proudů v právní vědě, který se objevil během 80 a 90. let a ovlivňuje současné myšlení o právu. Postmodernismus přitom představuje velmi široké spektrum teorií a východisek. Výuka se proto omezí na hlavní směry a aplikace ve vztahu k právní vědě.
Dílčí cíle kurzu
uvést do problematiky postmodernismu ve vztahu k právu
seznámit se základními texty tohoto proudu v právní vědě
umožnit kriticky zhodnotit originalitu postmodernismu v právu a pochopit ho v kontextu celkového vývoje právní vědy
demonstrovat dopad tohoto směru v právní vědě na jednotlivé obory pozitivního práva
zdůraznit souvislosti právnické recepce postmodernismu s ostatními sociálními vědami a politickou filosofii.

Part I.
The purpose of the course is to introduce students to one of the newest currents of legal science, which has appeared during the 1980s and 1990s, and in a fundamental way to influence current legal thinking. Post-structuralism in itself presents a very wide spectrum of theories and starting-points. That is why the teaching is limited to three main directions of legal science, which usually are joined within a post-structuralism U-turn and present crucial theoretical impulses for legal philosophy and for individual branches of good law. The first direction is the reception of the French philosopher Michel Foucalt, especially his analyses
of power, discipline and norms. The second direction is deconstruction of law, justice and
the laws, as it appears in the texts of Jacques Derida and also in several representatives of the so-called Critical Legal Science. The third direction is afterwards the separation of the basic
Legal theoretical themes, as does for example the American legal and literary theoretician
Stanley Fish attempts to do in today\s pragmatism.
Partial purposes of the course are:
o to introduce into the issues of post-structural conception of law
o to gain knowledge of basic texts of the post-structural current in legal science
o to allow for a critical evaluation of the originality of post-structuralism in law and to understand it in the context of the entire development of legal science
o to demonstrate the influence of this direction in legal science to individual disciplines of positive law
o to stress the relation between legal reception of post-structuralism and the other social sciences and political philosophy.

o A critical evaluation of the possibilities and limitations of the application of post-modernism (post-structuralism in legal science).
o Modern legal science and the post-modern situation. The circumstances which condition
the expansion of the post-modern situation. The stochastic character of this development.
o The changing position of the state. The manifestations of post-modern situations in the fields of constitutional and administrative law. F.Barany’s thoughts, their critical reflections.
o Manifestations of post-modern situations in the fields of criminal law and criminal proceedings.
o J. Macura’s thoughts, their critical reflections. Post-modernism and civil judicial proceedings.
