Anotace - angličtina
The course is accredited by KU Leuven. Course leader: Prof. Frank Hendrickx (KU Leuven). The following subjects and approaches are offered in different modules. The first part (modules 1 and 2) aims at introducing students to the concepts of law, sport legal system and provide an overview of domestic and national dimensions as well as the different conflict solutions mechanisms. The second part (modules 3 to 8) is leaded by KU Leuven and elaborates major themes and issues in sports law and integrity regulation. Module 1. An introduction to the Law of Sports A very short introduction to the concept of Law The distinction between domestic and International Law, The European dimension of sport and the EU legal system. The European Sport Charter Towards a global Sports Law System.The emergence of Lex Sportiva The role of the Court of Arbitration for Sports and its Jurisprudence in the creation of Lex Sportiva Module 2: Conflict Resolution in Sport 1. overview is created for working and functioning in an internationally oriented environment in the world of sport in relation to governance and integrity issues.

 After completing this course the student is able to:

  • Identify legal sources.
  • Distinguish legal rights from moral rights
  • Identify and distinguish legal obligations from other kind of duties, particularly from moral duties
  • Consult national and international legal sources, understand them and explain them both separately and in their mutual interaction
  • Identify the specificities and laws of sports law
  • Understand the meaning and scope of the Lex Sportiva
  • To assess and explain the importance and influence of European law in sport
  • Identify and explain the important court rulings in sports law
  • Identify and explain the main sources of international regulation and their influence on the sports world
  • To answer legal questions relating to sport and to use legal arguments for this
  • Recognize sports legal issues and communicate clearly with lawyers
  • To encourage critical thinking and value-driven decision making

Type: Partial or continuous assessment with (final) exam during the examination period

Description of evaluation: Written, Paper/Project, Presentation

Type of questions: Open questions

Learning material: Course material

Modules 1 and 2 are assessed by a written assignment, working group presentations and individual interviews (25%).

Modules 3 to 8 are assessed by a written exam in the normal examination period. The written exam is composed of a ‘closed book’ exam. The written exam will count for 75% of the total mark (15 points of 20)

Students are only accepted to do the written exam if they have completed the assignment in due time.

Students should cannot pass the course without having passed both the assignment and the written exam.

In case of a re-sit, students will have to deliver a new assignment and take a new written exam in the third examination period.
