Trestní právo hmotné se zabývá ochranou nejdůležitějších hodnot ve společnosti proti trestným činům a jejich pachatelům tím, že vymezuje znaky jednání, která jsou trestnými činy, a stanoví sankce, které lze za jejich spáchání uložit. Trestní právo procesní upravuje postup orgánů činných v trestním řízení v součinnosti s dalšími orgány, fyzickými a právnickými osobami při objasňování trestné činnosti, při zjišťování jejích pachatelů a při ukládání a výkonu sankcí.

Criminal law is one of the fundamental and traditional subjects taught at the Law Faculty of the Charles University, and is part of the group of so-called "judicial subjects". The most relevant elective subjects are Criminology and Criminalistics. The subject is divided into substantive criminal law and criminal procedure. Substantive criminal law primarily defines a criminal act (and its distinction from other delicts), its statutory characteristics (elements of a crime - harm, actus reus, offender, mens rea), and the elements of individual crimes. The course further explores the requirements for the perpetrator´s criminal liability (age and sanity) and inchoate offences (stages of a crime - preparation and attempt, modes of participation - accomplice, organization, abetting and assistance). It also deals with defences (e. g. self-defence, necessity), concurrence of crimes, recidivism and extinction of punishability. The course then defines the concept, purpose and system of sentencing (including protective treatment measures), principles of their imposition, as well as individual types of sentences. Finally the course deals with the extinction and expungement of conviction. Criminal procedure primarily defines basic principles on which a democratic criminal procedure is built. It also determines the position and responsibilities of parties to criminal proceedings (investigative, prosecuting and adjudicating bodies - the police, the prosecutor, the court; the defendant, the defence counsel, the injured person, accomplices etc.), requirements for and scope of restrictive measures (e. g. detention, custody, searches), as well as the rules of evidence and basic means of evidence (e. g. interrogation, expert´s opinion, site inspections, autopsies, etc.). Particular attention is paid to individual stages of a criminal trial (pre-trial proceedings, preliminary hearings of the indictment, the trial), decision-making in criminal proceedings, remedies against judgments and enforcement of judgments.
The criminal law module focuses on: 1. Acquiring theoretical background in criminal law, in compliance with the standards set by developed democratic countries, and taking into account relevant comparative legal studies, the trends promoted by the UN and the Council of Europe, and the harmonisation pursued by the EU. 2. Acquiring working knowledge of Czech criminal law. Students should acquire the skills necessary to interpret the rules of criminal law and apply them to specific cases. Interpretation de lege ferenda will be included as well. 3. Acquiring the skills to express one´s arguments adequately and accurately, using appropriate terminology.
