Předběžná náplň práce |
Diplomová práce se zaměřuje na význam a potřebu výuky etiky na právnických
fakultách. Základní tezí této práce je, že etika by měla být jedním z nejdůležitějších předmětů na právnických fakultách. Pro podporu této teze jsou zkoumány tři klíčové otázky: proč učit etiku na právnických fakultách, co učit v rámci výuky etiky, a jak přesně výuku etiky vyučovat. Práce využívá analýzu psychologických studií, rešerše relevantní odborné literatury, zejména zahraničních zdrojů, a místy i komparatistiku stavu výuky etiky ve Spojených státech amerických se stavem v České republice. Výsledkem je obhájení základní teze a poskytnutí obecného referenčního rámce, který může být použit pro další evoluci právnického vzdělávání. Práce také otevírá prostor pro další diskusi o nutnosti změn ve výchově budoucích právníků a nabízí směr, jakým by se mohla tato výuka ubírat, včetně integrace didaktických metod. Práce je strukturována tak, že postupuje výkladem od abstraktního ke konkrétnímu. Zároveň každá kapitola staví základ pro pochopení té následující. V první kapitole práce poskytuje obecná definiční východiska. Zevrubně vysvětluje, co je to morálka, etika, jaký je vztah práva a morálky, či co je to právní etika. Po objasnění těchto definičních východisek práce navazuje kapitolou, kde předkládá argumenty na otázku proč etiku na právnických fakultách vlastně učit. V ní se věnuje širokému spektru zdrojů od psychologických studií až po historické okolnosti vývoje výuky etiky na právnických fakultách ve Spojených státech amerických. Ve třetí kapitole práce přechází ke konkrétní analýze výukových cílů a didaktických postupů při výuce etiky na právnických fakultách. V této kapitole se práce opírá o závěry různých studií z oblasti vývojové psychologie i osobních zkušeností světových špiček v oblasti výuky etiky na právnických fakultách. Pozornost je také věnována tomu, jestli a případně jak měřit pokrok studentů v oblasti etické citlivosti a rozvoje jejich profesní etické identity. |

The thesis focuses on the importance and need for teaching ethics at law schools. The
basic thesis of this text is that ethics should be one of the most important subjects in law schools. To support this thesis, three key questions are explored: why teach ethics in law schools, what to teach in teaching ethics, and how exactly to teach ethics. The thesis employs an analysis of psychological studies, a search of relevant literature, particularly foreign sources, and, in places, a comparative analysis of the state of ethics teaching in the United States with the state of ethics teaching in the Czech Republic. As a result, the basic thesis is defended and a general frame of reference is provided that can be used for the further evolution of legal education. The thesis also opens the space for further discussion on the necessity of changes in the education of future lawyers and offers a direction in which this teaching could be directed, including the integration of modern didactic methods. The thesis is structured in such a way that it proceeds in an explanatory way from the abstract to the concrete. At the same time, each chapter lays the foundation for understanding the next. In the first chapter, the thesis provides a general definitional background. It explains in detail what morality is, what ethics is, what the relationship between law and morality is, or what legal ethics is. After explaining these definitional backgrounds, the thesis continues with a chapter where it presents arguments on the question of why ethics should be taught in law schools in the first place. In it, it discusses a wide range of sources, from psychological studies to the historical circumstances of the development of the teaching of ethics in law schools in the United States. In Chapter Three, the thesis moves on to a specific analysis of the instructional goals and didactic practices for teaching ethics in law schools. In this chapter, the thesis draws on the findings of various studies in the field of developmental psychology as well as the personal experiences of world leaders in the field of teaching ethics in law schools. Attention is also given to whether and, if so, how to measure students' progress in ethical sensitivity and the development of their professional ethical identity. |
