Předběžná náplň práce

Tato diplomová práce se zaměřuje na téma trestných činů z nenávisti a jejich aspektů pohledem kriminologie. Jejím cílem bylo poskytnout ucelený souhrn zejména kriminologicky zaměřených informací o problematice trestných činů z nenávisti v České republice. Práce je rozdělena do pěti kapitol, které jsou dále členěny na jednotlivé podkapitoly.
V první části práce jsou rozpracovány základní pojmy. Kapitola první se vypořádává s vymezením trestného činu z nenávisti a zaměřuje se na jeho specifika oproti „běžné“ trestné činnosti. Ve druhé kapitole je věnován prostor pojmům, které s trestnou činností z nenávisti souvisí, a to násilí z nenávisti, předsudečné násilí, předsudečná nenávist, extremismus, antisemitismus, nacionalismus, homofobie, islamofobie a xenofobie. U pojmu extremismu se pozastavuji a zaměřuji se na propojení mezi trestnou činností z nenávisti a extremismem.
Následující třetí kapitola má za úkol popsat aktuální i žádoucí právní stav v oblasti trestných činů z nenávisti. Nejprve v ní popisuji trestné činy z nenávisti de lege lata a následně uvažuji nad možnými zákonnými změnami a nenávistné trestné činy posuzuji de lege ferenda.
Čtvrtá a poslední kapitola obsahuje hlavní problematiku diplomové práce, a to kriminologické aspekty trestných činů z nenávisti. Tato část práce je rozdělena do tří podkapitol, ve kterých je zpracováno, jak lze trestné činy vnímat z pohledu pachatele, oběti a státu. U pachatele trestného činu z nenávisti uvádím faktory, které ovlivňují vznik deliktního jednání, vysvětluji, jaké jsou zvláštnosti páchání nenávistných činů, a dle dostupných statistik typizuji jejich pachatele. K tématu oběti trestného činu z nenávisti diplomová práce nejprve nabízí vymezení pojmů oběti a oběti trestného činu z nenávisti. Posléze je rozpracováván trojí dopad trestného činu z nenávisti, který směřuje proti bezprostřední oběti, skupině obyvatel, ke které oběť náleží, a státu. Dále je i zde vycházeno z dostupných statistik a je z nich zjištěno, jaké skupiny osob byly v posledních letech nejčastěji terčem předsudečného násilí a jaký typ újmy jeho oběti nejvíce utrpěly. Nakonec se krátce věnuji postavení oběti v trestním řízení. V poslední části čtvrté kapitoly je zpracován postoj státu a jeho orgánů činných v trestním řízení ve vztahu k nenávistné kriminalitě.

Předběžná náplň práce v anglickém jazyce

This diploma thesis focuses on the topic of hate crimes and their aspects from the perspective of criminology. Its aim was to provide a comprehensive summary of information, especially criminological information, on the issue of hate crimes in the Czech Republic. The work is divided into five chapters, which are further divided into individual subchapters.
In the first part of the thesis there are mentioned the basic concepts. The first chapter deals with the definition of hate crime and focuses on its specifics compared to "ordinary" crime. The second chapter deals with concepts related to hate crime, namely hate violence, prejudiced violence, prejudiced hatred, extremism, anti-Semitism, nationalism, homophobia, Islamophobia and xenophobia. Specially I dwell on the concept of extremism and think of the link between hate crime and extremism in it.
The aim of he following third chapter is to describe the current and desired legal situation of hate crimes in the Czech republic. First I describe hate crimes de lege lata and then I think about possible legal changes and consider hate crimes de lege ferenda.
The fourth and the final chapter contains the main topic of the diploma thesis, which are the criminological aspects of hate crimes. This part of the work is divided into three subchapters, which deals with perspectives of three subjects, that are the offender of a hate crime, the victim and the state. For the perpetrator of a hate crime I state the factors that affect the occurrence of criminal conduct, explain the peculiarities of committing hate crimes, and according to the available statistics, I define their typical perpetrators. On the topic of victims of hate crime, the diploma thesis first offers a definition of the victims and the victims of hate crime. Then I explain the triple impact of hate crime, which means their heading against the immediate victim, the group to which the victim belongs and the state. Furthermore the thesis again works with the available statistics, from where is found out which groups of people have been the most frequently attacked with hatred in recent years and what type of harm the victims of these assaults have suffered the most. Finally, I briefly describe the position of the victim in criminal proceedings. The last part of the fourth chapter deals with the attitude of the state and its bodies active in criminal proceedings in relation to hate crime.
