Bakalářská práce se zaměřuje na zvláštní administrativní oblasti (ZAO) ČLR Macao a
Hongkong, přičemž je rozdělena na dvě případové studie a závěrečnou komparaci těchto studií. Cílem práce je zjistit, zdali hrozí ztráta vysokého stupně autonomie a jedinečnosti jednotek. Zvláštní administrativní oblasti převzali po koloniální správě systém řízený výkonnou mocí a místní instituce se tedy v nemálo ohledech inspirovali právě institucemi portugalskými či britskými. Z toho důvodu se případové studie zabývají nejprve koloniálním obdobím, na které navazuje část pojednávající o čínsko-portugalských a čínsko-britských prohlášeních. Na tvorbě jednotek se totiž podílela nejen ČLR, ale i samotné mateřské země, díky kterým získali kolonie svoji jedinečnost. Ta pramenila ze systému řízeného výkonnou mocí, který byl nehledě na zdánlivou nedemokratičnost schopen efektivního a v jádru liberálního vládnutí založeného na západních právních tradicích. Práce pro posouzení jedinečnosti institucí obsahuje extraktivně inkluzivní škálu, díky níž je autor schopen zařadit instituce jednotek buď jakožto moc hromadící (extraktivní) či rovnost podporující (inkluzivní). Po vypsání historie jsou koloniální instituce zařazeny jakožto extraktivně-inkluzivní (střed škály). Stav institucí ZAO k roku 2023 je zjištěn pomocí zkoumání přijatých zákonů a následné reakce obyvatel v podobě demonstrací, přičemž je brána v potaz i identita místních obyvatel. Po analyzování současné politické situace jsou instituce obou administrativních oblastí označeny za extraktivní s inkluzivními prvky, což implikuje větší hromadění moci a menší rovnost ve společnosti. |

The bachelor thesis focuses on the Special Administrative Regions (SARs) of the PRC, Macao
and Hong Kong, and is divided into two case studies and a final comparison of these studies. The aim of the thesis is to determine whether the high degree of autonomy and uniqueness of the units is at risk of being lost. The special administrative regions have taken over from the colonial system of executive-controlled administration, and local institutions have thus in no small measure been inspired by Portuguese or British institutions. For this reason, the case studies deal first with the colonial period, followed by a section on the Sino-Portuguese and Sino-British declarations. Indeed, not only the PRC but also the mother countries themselves were involved in the creation of the units, which gave the colonies their uniqueness. This stemmed from an executive-led system that, despite its apparent undemocratic nature, was capable of effective and, at its core, liberal governance based on Western legal traditions. To assess the uniqueness of the institutions, the work includes an extractive-inclusive scale, through which the author is able to classify the institutions of the units as either power accumulating (extractive) or equality-promoting (inclusive). After listing the history, colonial institutions are classified as extractive-inclusive (middle of the scale). The state of the SAR institutions as of 2023 is established by examining the laws passed and the subsequent response of the population in the form of demonstrations, taking into account the identity of the local population. After analysing the current political situation, the institutions of both administrative areas are identified as extractive with inclusive elements, implying a greater accumulation of power and less equality in society. |
