Tématem této diplomové práce je úprava nájmu nemovitostí v českém právním
řádu, se zaměřením též na otázky nájmu nemovitostí v právu anglickém. Práce se snaží čtenáři podat základní informace o této problematice. Práce je systematicky členěna na nájem pozemků a staveb spojených se zemí pevným základem. Dále se diplomová práce věnuje také vymezení základních pojmů, jako je například věc v právním smyslu. Vzhledem k přijetí nového občanského zákoníku je v současné době v České republice aktuální otázka změny právních poměrů souvisejících s nájemními vztahy k nemovitostem. Proto lze v práci na několika místech nalézt srovnání účinné a platné právní úpravy. Snaží se upozornit na nejvýraznější změny, které v českém právním prostředí v souvislosti s nájmem nemovitostí nastanou po dni 1. 1. 2014. V neposlední řadě je účelem této práce vyzdvihnout nejdůležitější aspekty právní úpravy nájmu nemovitostí v anglickém právu. A dále anglickou právní úpravu porovnat s úpravou českou a vymezit základní rozdíly dané problematiky v obou zemích. Diplomová práce je členěna na úvod, pět základních kapitol a závěr. Každá z kapitol se věnuje určité otázce, které se buď přímo, nebo zprostředkovaně týká nájmu nemovitostí. První kapitola obsahuje základní terminologii, která souvisí s nájmem nemovitostí. Jedná se o definici pojmu věc v právním smyslu a následně konkrétně věci nemovité. Charakteristika nemovitosti obsahuje jak definici pozemku, tak i stavby spojené se zemí pevným základem. Následuje kapitola druhá, jenž se zaměřuje na problematiku zásady „superficies solo cedit“. Vymezuje její uplatnění nejen v České republice ale také na území Anglie a 76 Walesu. V českém právu pak poukazuje na změnu, kterou přinese nový občanský zákoník v souvislosti s touto římskou právní zásadou. Třetí kapitola se jmenuje nájem pozemku. Zde lze najít obecnou charakteristiku nájmu pozemku, podstatné náležitosti nájemní smlouvy a vymezení subjektů nájemního vztahu. V neposlední řadě se kapitola zaměřuje na právní důvody zániku nájemního vztahu, jehož předmětem je pozemek. Je možné se zde seznámit s rozdílem mezi smlouvou nájemní a pachtovní, která je již nyní velmi aktuálním aspektem platné právní úpravy. Čtvrtá kapitola se věnuje problematice nájmu staveb spojených se zemí pevným základem. Podává stručný exkurz do zákonných ustanovení, jenž se uplatňují na nájem budov pronajatých jako celek nebo pouze jejich částí. Pátá kapitola má za cíl vyložit právní aspekty nájmu nemovitostí ve Spojeném království Velké Británie a Severního Irska, speciálně se zaměřením na právo anglické. Dosažené závěry chce porovnat s českou právní úpravou a nalézt mezi nimi nejvýraznější rozdíly. |

The subject of the thesis is the lease of real estate amended by Czech law and some
aspects of the lease of real estate amended by English law. This thesis tries to provide the reader with basic information about these issues. The thesis is systematically divided into two sections- the lease of land and the lease of building firmly connected with the land. It is focused on fundamental terms such as the thing in legal sense. The question of changes in an area of lease of real estate is quite actual because of passing the new civil code in the Czech Republic. That is why the thesis contains a comparison between the effective civil code and civil code in force. It points out the most significant amendments which will become effective on 1. 1. 2014. The other purpose of this thesis is to highlight the most important aspects of legal regulation of lease of real estate in English law. The thesis compares the Czech legal regulation with English one and defines the basic differences of this issue in both countries. The thesis is structured into introduction, five elementary chapters and conclusion. Each chapter is focused on issue which directly or indirectly influences the lease of real estate. The first chapter contains the elementary terminology which is connected with the lease of real estate. It is a definition of a thing in legal sense and specifically a real estate. The characteristic of a real estate contains the definition both of land and building firmly connected with the land. The second chapter follows and focused on the issue of the principle “superficies solo cedit”. It specifies its application in the Czech Republic and in the area of England and Wales. It shows the modification which will be brought by the new civil code in connection with this Roman principle in the Czech Republic. 78 The name of the third chapter is the lease of land. There is a general characterization of lease of land, essential requirements of a lease and definition of subjects. The chapter is also focused on legal grounds of the termination of the lease relations connected with the land. There is described the difference between the contract of lease and contract of “pacht” which is very actual aspect of legal regulation. The fourth chapter is focused on lease of building firmly connected with the land. It distinguishes the difference between the lease of a building as a whole and the lease of a part of it. The goal of the fifth chapter is to interpret the legal aspects of lease of real estate in the United Kingdom of Great Britain and Northern Ireland. Achieved conclusions are compared with the Czech legal regulation. The chapter tries to find out the most important differences between them. |
