Cílem diplomové práce je zmapovat právní úpravu možností udělení patentů na výzkumu v oblasti medicíny, s kterými jsou spojena morální rizika a jsou tedy předmětem zkoumání bioetiky. Ústředním tématem diplomové práce budou patenty v oblasti výzkumu na lidských embryonálních kmenových buňkách (HESc)a patenty v oblasti nanočástic. Lidské embryonální kmenové buňky mají velký léčebný potenciál, ale způsob jejich získávání nutně vede k tomu, že je zničeno „lidské embryo“. V práci je kladen důraz především na právní úpravu dané oblasti v právu Evropské unie a na aktuální přelomový rozsudek ve věci Brüstle vs. Greenpeace eV.

Main aim of this diploma thesis is to assessed law regulation in the field of granting patents in the area of medical research. This paper deals with the legal regulation on patentability of research concerned with the human embryonic stem cells{HESc} which might have a great therapeutic potential but their preparation necessarily leads to the destruction of “human embryos”. The work is mainly focused on legal regulation in the European law and the current ground-breaking judgement Brustle v. Greenpeace eV. Furthermore, the work deals with the legal regulation on patentability and federal funding of human stem cell research in the United States.Second part of the diploma thesis is about patents in nanomedicine.
