Cílem této diplomové práce je poskytnout širší pohled na právní ochranu klimatického systému Země. Pro ochranu klimatického systému bylo vždy typické, že je ovlivněna nejen mírou vědeckého poznání, ale ve značném rozsahu také politikou a stavem světového hospodářství. Proto se práce bude zabývat tím, jak formování právního rámce ochrany klimatu ovlivnily stav vědy, vývoj mezinárodních vyjednávání a ekonomická teorie. Samotné jádro práce nicméně bude spočívat v analýze právního rámce tvořeného Rámcovou úmluvou o změně klimatu, Kjótským protokolem a směrnicí EU ETS.

This thesis aims to provide a broad view of legal protection of the Earth’s climate. The legal protection of climate has always been influenced not only by the science itself but also by the political situation and the performance of the world economy. Therefore the paper will look at how the science, the international negotiations and the economic theories have shaped the climate change law. Nevertheless the core of the thesis will be devoted to the analysis of the legal framework consisting of the Framework Convention on Climate Change, the Kyoto Protocol and the EU ETS Directive.
