Předběžná náplň práce

Předkládaná práce se snaží proniknout do podstaty autonomního postavení Jižního Tyrolska v rámci Italské republiky. Jihotyrolská autonomie bývá nezřídka dávána v Evropě i ve světě za příklad. Za toto kladné hodnocení vděčí jedinečnému historickému vývoji, který umožnil mechanismus ochrany menšiny budovat na základě mezinárodních jednání, přičemž samotnou zásadní otázkou této práce je mezinárodněprávní charakter Pařížské smlouvy, klíčového dokumentu z roku 1946, od něhož se odvíjel vývoj vedoucí k urovnání sporu mezi Itálií a Rakouskem v roce 1992. Z tohoto poznatku vychází teze práce, že řešení mezinárodní otázky spočívalo v současném odblokování souboru na sobě závislých problémů, se kterým se bylo nutno vypořádat jednotným postupem, přičemž prvotní jednostranné řešení ve formě prvního autonomního statutu z roku 1948 vedlo ke krachu vykrystalizovaném terorismem tzv. ohnivé noci roku 1961. Teprve konkrétnější mezinárodní jednání přinesla roku 1969 dohodu na podobě druhého autonomního statutu formou balíčku opatření, jehož uskutečnění konkretizoval tzv. operační kalendář. Splněním podmínek vázaných Pařížskou smlouvou ze strany Itálie a prohlášením souhlasu ze strany Rakouska byla věc roku 1992 završena. Pro pochopení teze je zcela zásadní právní význam uvedených dokumentů, proto je postupem práce podrobení těchto dokumentů právní kvalifikaci.

Předběžná náplň práce v anglickém jazyce

The present thesis seeks to explore the essence of the autonomous status of South Tyrol within the Italian Republic. South Tyrolean autonomy is often held up as an example in Europe and the world. It owes this positive assessment to a unique historical development that allowed the mechanism of minority protection to be built on the basis of international negotiations, the very core issue of this thesis being the international legal character of the Gruber–De Gasperi Agreement, the key document of 1946, from which the developments leading to the settlement of the dispute between Italy and Austria in 1992 were derived. From this insight, the thesis of the thesis is that the resolution of the international question consisted in the simultaneous unblocking of a set of interdependent problems that had to be dealt with in a unified manner, with the initial unilateral solution in the form of the first autonomous statute of 1948 leading to a collapse crystallized by the terrorism of the so-called "Night of Fire" of 1961. Only more concrete international negotiations brought about agreement in 1969 on the form of a second autonomous statute in the form of a package of measures, the implementation of which was concretised in the so-called operational calendar. The fulfilment by Italy of the conditions of the Gruber–De Gasperi Agreement and the declaration of consent by Austria brought the matter to a close in 1992. The legal significance of these documents is crucial to the understanding of the thesis, and the procedure is therefore to subject them to legal qualification.
