CONCLUSION The most important achievement of the legislation in terms of penal laws is the adoption of the new Criminal Code (Act No. 40/2009 Coll.) which significantly modifies and modernizes Czech penal law. Criminal Code shall enter into force on the 1st January. The new code shall replace the existing Criminal Code (Act No. 140/1961 Coll. as amended). Particularly, the new codification of the substantive penal law may be characterized as follows: Following the intensification of the conflicts in the society and the new negative phenomena as well as forms criminal activity, rising brutality, international crime and the gravidity of criminal offences the criminal repression is being made more restrictive by increasing the term of imprisonment form some criminal offences. Criminal Code classifies the criminal offences into misdemeanours (deliberate criminal offences with the term of imprisonment of up to 5 years and all negligence criminal offences) and felonies (deliberate criminal offences with the term of imprisonment exceeding 5 years); the legal regulation isn´t purposeless, but it is reflected in coherent provisions of substantive a procedural penal law (e.g. sentence of community service shall be imposed only for having committed the misdemeanour; in terms of misdemeanour, the diversion in form of the suspension of the prosecution is admissible) and moreover, it creates foundation for a more effective determination of processes in the future recodification of procedural penal law which will make the procedure more flexible even within the context of the categorization. The system of penalties is completed by the house arrest sentence which is a type of sentences enabling the punishment of the offender without being ripped out of his own family and the nearest surroundings; it is another feature of humanization of penal law even in this field of repressive state policy. 89 Further, sentence of prohibition of entry the sports, cultural or other social events is being introduced which may be imposed for having committed a criminal offence for the term of up to ten years; the convicted is banned from participation in given sports, cultural or other social events. The Criminal Code only implies the substance of the substantive penal law which is being taken over from the current legal regulation of penal law. The necessary amendments reflected in other legal statues are included in the draft bill of the so-called accompanying act. Among the amendments of essential nature, the important amendment of the Criminal Procedure. Act should be mentioned which reflects not only the changes in terminology but also some material changes. This is the question of change (reduction) of the possibility to release the accused person from the custody upon providing a deposit when having committed the enumerated criminal offences (Section 73a), specification of the domain of the criminal offences that require the approval of the aggrieved party (Section 163a), the concept of the cooperating accused person (Section 178a), etc. Among other important achievements in this field belongs especially the amendment of the Criminal Code and the Tax and Charge Administration Act making the punishment for bribery more strict (Act No. 122/2008 Coll.), Act on the Enforcement of the Security Detention (Act No. 129/2008 Coll.) and the amendment of the Criminal Procedure Act and Act on the Property of the Czech Republic (Act No. 457/2008 Coll.). The amendment of the Criminal Code and Tax and Charges Administration Act makes the punishment of the criminal offences of bribery and laundering more strict, ensures the international obligations of the Czech Republic in this field and perforates the confidentiality of the employees of the tax administrator upon submitting the incentive for commencement of the prosecution for having committed the criminal offence of bribery. 90 The goal of the enforcement of the security detention is to set up the detention institutions for the highly dangerous offenders that enable their isolation apart from the society. The amendment of the Criminal Procedure Act and the Act on the Property of the Czech Republic belongs to amendments focused on the field of international judicial cooperation in the criminal proceedings. This amendment enables an efficient cooperation of the Czech Republic with other Member States of the EU when draining the property acquired by the criminal activity away from the offenders of such criminal activity, especially in terms of cross – border criminality. Further it involves a complex regulation of the extradition of the person to abroad for the purposes of the criminal proceedings. 91
