89 CONCLUSION The most important achievement of the legislation in terms of penal laws is the adoption of the new Criminal Code (Act No. 40/2009 Coll.) which significantly modifies and modernizes Czech penal law. Criminal Code shall enter into force on the 1st January. The new code shall replace the existing Criminal Code (Act No. 140/1961 Coll. as amended). Particularly, the new codification of the substantive penal law may be characterized as follows: Following the intensification of the conflicts in the society and the new negative phenomena as well as forms criminal activity, rising brutality, international crime and the gravidity of criminal offences the criminal repression is being made more restrictive by increasing the term of imprisonment form some criminal offences. Criminal Code classifies the criminal offences into misdemeanours (deliberate criminal offences with the term of imprisonment of up to 5 years and all negligence criminal offences) and felonies (deliberate criminal offences with the term of imprisonment exceeding 5 years); the legal regulation isn't purposeless, but it is reflected in coherent provisions of substantive a procedural penal law (e.g. sentence of community service shall be imposed only for having committed the misdemeanour; in terms of misdemeanour, the diversion in form...
