Abstrakt Tato rigorózní práce se zabývá problematikou odpovědnosti za škodu na zdraví v českém občanském právu. Jejím cílem je popis současné legislativy a jeho srovnání s novou právní úpravou, jež nabývá účinnosti na počátku roku 2014. Dosavadní právní úpravu hodnotím jako v mnoha a ohledech nedokonalou a oceňuji, že nový občanský zákoník řadu z těchto nedostatků odstraňuje. Ani nový občanský zákoník však nepovažuji za zcela bezchybný a z toho důvodu připojuji řadu osobních návrhů.
Abstract:
Abstract This thesis deals with the problems of lability for bodily injury in our civil law. It attempts to describe the legal situation being currently in the force and to compare it to the new legislation coming into force at the beginning of 2014. On one hand I have found out several deficiencies of the contemporary legislation, on the other hand I have discovered several solutions of the new act improving these defects. Nevertheless I cannot consider the new Civil Code to be completely faultless. For this reason I also add some personal proposals.
