The aim of the course is to provide students with an understanding of the legal aspects of migration caused by environmental change, focusing primarily on climate-induced migration as the most significant contemporary subcategory of environmental migration. The course connects environmental law with migration and refugee law. In the former field, it examines States' obligations to prevent environmental changes that cause or may cause the displacement of persons; in the latter, it examines the legal status of migrants and States' obligations to provide them with protection. It places the still inconsistently accepted concept of environmental, or more specifically climate, migration within the existing legal framework and analyses possibilities for its further development.
Upon completion of the course, students will understand the concept of environmental, or more specifically climate, migration and its contested aspects. They will be able to identify States' obligations aimed at maintaining a healthy environment and apply the concepts and instruments of migration and refugee law to persons displaced for environmental reasons. They will also be able to analyse the possible application of international responsibility of States in connection with environmental migration. Students are expected to read the assigned materials or otherwise prepare for each seminar in advance, usually for one to two hours per week. The course combines lectures, guided discussions and independent work, both individual and group-based. The course develops a range of legal skills, including: - the ability to navigate international environmental law and international migration and refugee law - the ability to find and analyse relevant case-law and decisions of other international bodies - the ability to analyse specific legal issues - legal argumentation skills - the ability to engage in informed discussion of environmental migration in a broader context These skills will be acquired primarily through work in seminars. V případě nemožnosti konání kontaktní výuky bude výuka probíhat formou online webinářů v čase přednášek, a to prostřednictvím Zoom. Studentům budou předem zpřístupněny podkladové materiály v Moodle. Tím, že používám techniku převrácené třídy (flipped clasroom), je příprava na seminář nutná, v semináři už látku jen procvičujeme. 1. The colloquium takes the form of a presentation and defence of a final paper on a topic related to the course content and agreed with the course leader. 2. The student's overall performance is assessed as follows: a maximum of 100 points may be obtained, including 40 points for participation in classes, 50 points for the final paper and its defence, and 10 points for participation in the discussion of other students' final papers. 3. At least 70 points are required to pass the colloquium. 4. Attendance at no fewer than 70% of classes is required. 5.
