The interest of the constitutional law as a science is focused on the creation and application of power in the state, division of government and defining the limits of the government, determining the powers of individual state bodies and the relationships among them. In addition to the issues of implementation of state power the constitutional law also deals with human rights and fundamental freedoms and the relationship between the state and its citizens in general. The constitutional law also interprets legal rules related to the Constitution such as the Act on the Constitutional Court of the Czech Republic, the Act on the Czech National Bank, but also other laws and deals with the issues of elections or citizenship. The students work with international treaties and decisions of the Constitutional Court of the Czech Republic as primary sources of law. |

Informace katedry ústavního práva ke klasifikovanému zápočtu:
ÚSTAVNÍ PRÁVO I - CŽV KLASIFIKOVANÝ ZÁPOČET
Za letní semestr ak. r. 2019/2020 (písemná forma, termíny pro celý ročník /bez ohledu na seminární skupiny/, studenti se hlásí prostřednictvím IS).
Struktura testu: - 10 testových otázek; zadání vychází z textu Ústavy nebo prováděcího zákona (s alternativami odpovědí a), b), c), d) - jedna odpověď je správná), hodnocení správná odpověď = 1 bod (max. 10 bodů); - 2 otázky na výklad pojmů a právních institutů (odpověď vypracuje student), hodnocení až 2 body za vyčerpávající odpověď (0 až 2 body) (max. 4 body); - 1 otázka procesního charakteru (tvorba nebo aplikace zákona popř. rozhodnutí ústavního orgánu na konkrétním příkladu), hodnocení až 3 body za vyčerpávající odpověď (0 až 3 body) (max. 3 body) - 1 otázka na judikaturu Ústavního soudu (argumentace navrhovatele a účastníka řízení, stručné odůvodnění nálezu apod. – může se vztahovat pouze k institutům, jež jsou předmětem výuky v letním semestru (0 – 3 body) (max. 3 body)
Koše pro testové otázky: počet otázek A. ústavní vývoj 1918 – 1992 1 B. teoretická východiska Ústavy nebo základní pojmy (preambule, I. hlava Ústavy) 1 C. ústavní pořádek ČR a vztah k mezinárodnímu (evropskému) právu 1 D. volby a referendum (koncepce, proces) 2 E. moc zákonodárná 1 F. legislativní proces 1 G. prezident republiky 1 H. vláda, ministerstva a jiné správní úřady 1 I. státní zastupitelství nebo veřejný ochránce práv 1
Zadání bude z materie přednášek, předpisů ústavního pořádku, prováděcích předpisů i judikatury Ústavního soudu. Pro každý termín bude vytvořena varianta A a varianta B
Čas na vypracování: 40 minut
Hodnocení (je možné dosáhnout maximálně 20 bodů): 20 - 18 bodů = výborně; 17 – 15 bodů = velmi dobře; 14 – 12 bodů = dobře; 11 a méně bodů = neprospěl(a); do IS se vkládají všechny známky (i „4“); třetí „4“ se do IS nevkládá |
