Předmět je historickým úvodem do platného práva všech církví a náboženských společností v ČR a do současného konfesního práva českého státu. Soustřeďuje se především na ústavní právo církví (náboženských společností) působících v ČR, jejich legislativní činnost, strukturu církví a spolčovací právo uvnitř církví.

It is the first and most general branch of law from amongst those dealing with legal concepts relating to the exercise of freedom of worship and the status of churches and religious communities as taught at the Law Faculty of Charles University. As an elective subject, it is included in the course offerings as early as in the first year of study, nevertheless students are free to enter the course on an elective basis in one of the subsequent years as well. The purpose of the subject of Ecclesiastical Law is to teach the basics of history to students. Therefore they are recommended to study Ecclesiastical Law as a general subject before they take more specialized courses in their second year. However, students are not required to follow this recommended order.

The first portion of the subject consists of a legal and historical introduction to laws relating to religion: Canon Law, Law of the Catholic and Orthodox Churches, Law of the Protestant Church, law of other churches and religious communities, State Law of Confession and Concordat Law and Ecclesiastical Contract Law in the Czech lands and other countries of Central Europe. In the course the students are acquainted with the structure of all churches and religious communities in the Czech lands throughout their historical development, as well as the status of religious legal entities organized by churches and religious communities. It provides information on the history of Theory of Canon Law, Ecclesiastical and Confession Law in the Czech lands from the Middle Ages to the present time.

Another portion of the subject is made up of a presentation of the general rules of Canon Law of the Roman Catholic Church as they are included in the first book of the Canon Law Code 1983. There is continuity between the presentation of the above legal concepts and the traditional presentation of ecclesiastical law at law faculties in periods preceding the onset of the totalitarian regime, this format introduces the students to the second largest system of law in history alongside Roman Law and teaching the basics of European legal thought to them.

The third part of the subject deals with the development of Constitutional Law of churches and religious communities observed from the point of view of an individual (a member of the church), as well as the institution. Traditionally, one part is devoted to law relating to a person which was emphasised especially in older canon rules. The regulation of laws of individual churches and religious communities are examined, on the basis of which members of these churches become involved in the ministry (Law of Ordination), including the legal regulation of the formation (education) of the prospective ministers. In the case of the Catholic Church of Latin Rite, the Catholic Churches of the Eastern Rite and the Orthodox Church, the institutions of Monastic Law are also studied in detail, including the legal regulation of the education of the religious, and their legal status and regulations providing for the administration of religious orders and congregations.

In the fourth part of the subject, the legal regulation of preaching, teaching and other evangelistic activities of the churches and religious communities is presented, as well as the legislation governing the administration of individual sacraments and sacramentals and performing other rites and ceremonies.

Jde o první a nejobecnější z oborů práv pojednávajících o právních institutech vztahujících se k realizaci svobody náboženského vyznání a postavení církví a náboženských společností, které se vyučují na Právnické fakultě Univerzity Karlovy. Je zařazen jako výběrový předmět již do prvního ročníku, studentům je však ponechána možnost přihlásit si ho jako výběrový předmět i v některém z vyšších ročníků. Předmět církevní právo plní historicko-propedeutickou funkci. Proto se studentům doporučuje, aby církevní právo jako obecněji pojatý obor absolvovali dříve než navazující obory podrobněji specializované, vyučované od druhého ročníku, není to však podmínkou.

První část předmětu obsahuje právněhistorický úvod do náboženských práv: do kanonického práva katolického a pravoslavného, do církevního práva evangelického, do práva ostatních církví a náboženských společností, do státního konfesního i konkordátního práva a do církevního práva smluvního v českých zemích a jiných zemích střední Evropy. Seznamuje posluchače se strukturou všech církví a náboženských společností v českých zemích v jejich dějinném vývoji a s postavením církevních právnických osob církvemi a náboženskými společnostmi vytvářených. Informuje o dějinách vědy práva kanonického, církevního a konfesního v českých zemích od středověku po současnost.

Druhou část předmětu tvoří výklad obecných předpisů kanonického práva katolické církve latinské, jak jsou zachyceny v první knize Kodexu kanonického práva z roku 1983. Seznámení studentů s uvedenými právními instituty v jejich historickém vývoji navazuje na tradiční výuku církevního práva podávanou na právnických fakultách v dobách před nástupem totalitního režimu, která již tehdy studenty uváděla do znalostí druhého největšího historického právního systému vedle práva římského a učila je základům evropského právního myšlení.

Třetí část uvedeného oboru se zabývá ústavním právem církví a náboženských společností v jeho historickém vývoji, a to jak z pohledu jedince (člena církve), tak instituce. Tradiční oddíl zde tvoří osobní právo, zdůrazněné především ve starších kanonických předpisech. Probírají se předpisy práva jednotlivých církví a náboženských společností, na jejichž základě se stávají členové těchto církví příslušníky duchovního stavu (ordinační právo), včetně právní úpravy formace (výchovy) budoucích duchovních. V případě katolické církve latinské, katolických církví východních a církve pravoslavné se také podrobně probírají instituce řeholního práva včetně právní úpravy formace řeholníků a řeholnic a jejich právního postavení a včetně předpisů upravujících řízení řeholních řádů a kongregací.

Ve čtvrté části předmětu se vykládá právní regulace kazatelské, učitelské a jiné zvěstovatelské činnosti v církvích a náboženských společnostech a právní předpisy upravující udělování jednotlivých svátostí nebo svátostin a vedení jiných náboženských obřadů.
