Předmět je zacílen na studenty se zvláštním zájmem o mezinárodní právo trestní.
Cílem předmětu je:
- seznámit studující s aktuální judikaturou Mezinárodního trestního soudu a případně dalších trestních tribunálů (pokud bude existovat tematická souvislost s právními základy judikatury ICC),
- poskytnout prostor pro kritickou analýzu a skupinovou debatu nad judikaturou, či kvalitou právních pramenů a jejich aplikace,
- vytvořit pro studující prostředí, v němž se naučí (či prohloubí schopnost) prezentovat nejen názory nastudované ale i vlastní postavené na přednáškách a samostudiu,
- naučit studující písemně i ústně vyjádřit stanovisko a následně jej obhájit.
Aby bylo shora uvedených cílů dosaženo, vyžaduje se po studujících každotýdenní aktivní příprava na základě zadání pro každou přednášku spočívající v nastudování zadaného materiálu, přípravě odpovědí na předem položené otázky (ideálně včetně vyjádření se k ne/správnosti způsobu a formy aplikace pramene práva). Na domácí přípravu navazují tematicky zaměřené přednášky, během nichž kromě výkladu přednášející(m) rovněž studující odpovídají na v zadání položené otázky a rozebírají dané téma s lektorem/rkou a mezi sebou.
Předmět je vyučován v anglickém jazyce a předpokládá se i možnost zařazení studujících programu Erasmus, případně LLM apod. Proto je nezbytná znalost anglického jazyka umožňující aktivní debatu a porozumění právnímu textu.

Course assessment methods and requirements for successful completion, grading scheme - Czech

1.      Podmínkou možnosti absolvovat písemnou zkoušku je aktivita během přednášek (tj. připravenost k diskusi během přednášek na základě domácího zadání) - představuje 30 % celkové známky. Aktivita je buďto získána, nebo nikoliv, tedy 0 % nebo 30 %; a dále přítomnost při přednáškách v minimálním rozsahu 70 % přednášek. Ta není započítávána do celkové známky, je však podmínkou pro odevzdání eseje. Závěrečná esej představuje 70 % celkové známky.

2.      V prvním týdnu výuky studující dostanou na výběr ze tří témat eseje (příklad zadání: "What are the basis of criticism  of the ICC Appeals Chamber's decision on immunity of Al-Bashir?"; "Is the Role of Victims in the Proceedings in front of the ICC Improving Their Rights or Does It Prolongate the Proceedings?" atd.) a jejich úkolem bude do začátku zkouškového období odevzdat na téma, které si z nabídky vyberou, esej v rozsahu 3.000-3.500 slov (pouze vlastního textu práce, nepočítaje v to poznámky pod čarou a bibliografii) v anglickém jazyce.

3.      Hodnocení eseje bude postaveno na následujících kritériích: znalost práva (30 % hodnocení eseje), přesvědčivost a organizovanost vlastní argumentace (35 % hodnocení eseje), rozsah a relevance zdrojů a poznámkového aparátu (20 % hodnocení eseje), formální úprava eseje (15 % hodnocení eseje).

4.      Esej je třeba v písemné formě garantovi předmětu nejpozději v den začátku zkouškového období navazujícího na semestr, v němž byl předmět vyučován. Esej se odevzdává emailem na adresu garanta lipovsky@prf.cuni.cz.

5.      Formální úprava eseje:

-        Titulní stránka obsahuje pouze jméno a příjmení studující(ho), název předmětu, frázi "essay topic:" a vybrané téma eseje, akademický rok odevzdání eseje a počet slov vlastního textu eseje.

-        Vlastní text v anglickém jazyce, formát Times New Roman, velikost 12, řádkování 1,5 násobné, mezery mezi řádky 0.

-        Text je třeba řádně opatřit poznámkami pod čarou s použitými prameny.

-        Odkazy na literaturu a prameny musí být podle jednotného citačního vzoru, například OSCOLA International.

-        Bibliografie – do sekcí (mezinárodní smlouvy, rezoluce, knihy, články judikatura atd.) rozdělený seznam použitých zdrojů.

-        Dokument nesmí být uzamčen („pouze pro čtení“),

6.      Hodnotící škála:

-        0-50 %             4, neuspěl/a

-        51–70 %          3, dobře

-        71–90 %          2, velmi dobře

-        91–100 %       1, výborně

7.      Při zpracování písemné eseje je možno používat veškeré právní předpisy i jiné materiály.

Learning outcomes

Note: It is recommended for students applying to this course to already have passed exams from Public International Law and domestic Criminal Law. Consequently, the following learning outcomes build upon this expectation.

 

Upon completion of the course, the students will acquire the following knowledge and skills/competencies:

 

Generally (applicable to all topics):

During each lecture/in each topic taught that year, students will, while using the knowledge and skills described below

·         critically assess the examples of (excerpts from) case law of the ICC chosen by the lecturer(s),

·         formulate their own analysis on a given topic and

·         defend their own conclusions.

 

Specifically:

Students will

·         illustrate the role of the International Criminal Court (ICC) within the systematics of international criminal justice and distinguish it from other international criminal courts and tribunals (its establishing mechanisms, relationship to the United Nations and domestic jurisdictions),

·         explain and interpret the stages of process that led to the adoption of the Rome Statute of the International Criminal Court (RS) and exemplify the ad hoc international criminal tribunals the existence of which preceded / coexist with the ICC,

·         explain the relationship between the ICC and the United Nations, particularly the role of the UN Security Council in proceedings before the ICC,

·         analyse the forms of triggering mechanisms of the ICC proceedings and compare them from the perspective of scope of jurisdiction (ratione loci and ratione personae), 

·         specify and compare individual crimes under international law with ICC jurisdiction, demonstrate where and how to identify and apply their individual elements and analyse and evaluate specific ICC case-law related to individual crimes under international law,

·         demonstrate the differences between legal regimes governing the crime of aggression and other crimes within jurisdiction of the ICC, including scope of jurisdiction and leadership clause,

·         clarify the general regime of mens rea under Art. 30 RS, define what intent and knowledge means in relation to conduct, consequences and circumstances,

·         interpret the elements of crimes in hypothetical scenarios,

·         explain the mutual relationship between the sources of applicable law under Art. 21 RS, classify concrete examples within the systematics and identify the role of human rights before the ICC,

  • distinguish individual forms of criminal responsibility under Arts. 25 RS, analyse the superior responsibility under Art. 28 RS (including defining terms like knowledge, unconvinced knowledge) and demonstrate the interplay between the forms of responsibility and mens rea, 
  • illustrate specificity of various forms of responsibility (particularly direct and indirect perpetration of a crime, co-perpetration, ordering, soliciting, inducing, aiding and abetting, etc.) under the RS and critically analyse how the ICC interprets and applies them,
  • explain the contents of the principle of complementarity (including defining terms such as a case, a situation, unwillingness, inability and investigation), its role in admissibility of ICC action and explain how the principle operates in practice while predicting the impact of its various interpretations upon the legitimacy of the ICC,
  • categorize types of immunities from foreign criminal jurisdiction (personal and functional), describe their contents and possible limits of their applicability within the RS regime,
  • differentiate between horizontal and vertical effects of (non)applicability of immunities under Art. 27 RS,
  • evaluate the various doctrinal approaches to ICC attitude towards (non)applicability of personal immunities even to members of the “troika” of non-state parties,
  • exemplify the position, rights and role of victims in proceedings before the ICC, including participation in proceedings and reparations, define various forms of victims and harm and identify key legal provisions regarding victims under the Rome Statute and Rules of Procedure and Evidence.
