This course builds upon the basic introduction to mediation and negotiation. Its core lies in the so-called Oppenheimer Seminars, which are conducted in small student groups. Students actively participate in the preparation and teaching of specific topics, as well as in the practice of practical skills and knowledge. Throughout the course, students engage in interactive exercises and work through the mediation process in detail, including training in representing parties before a mediator.
Mediation is defined as assisted, structured negotiation of a dispute. It is the most commonly used of the so-called consensual ADR processes (alternative dispute resolution). Its popularity is growing worldwide, and most major legal systems today include some form of regulation of mediation. Globally, mediation is used to seek amicable resolutions in commercial, civil, labor, family, community, and other types of disputes. In the Czech Republic, mediation is regulated by the Mediation Act, which, together with the Civil Procedure Code, allows courts in civil matters to order a so-called first meeting with a registered mediator. Thanks to this provision, mediation has spread relatively quickly and is widely used as an out-of-court method of resolving conflicts, either before or during court proceedings. 1. The course is designed to be interactive and requires active student participation and ongoing preparation for each class. Throughout the semester, students are expected to engage in discussions and exercises. Students are allowed to miss up to two sessions during the semester. 2. To successfully complete the course requirements, students must: · Actively prepare for classes and participate in exercises (max. 8 points); · Take part in the final simulated mediation (max. 8 points); · Complete one project – participation in an Oppenheimer Seminar on a specific topic. The student’s opinions expressed in the project must be supported with proper citation of source documents. However, the student’s original contribution and critical thinking are also assessed. Absolvování Vyjednávání a mediace I před zahájením Mediation as Dispute Resolution se důrazně doporučuje jako nezbytný krok pro efektivní zvládnutí pokročilejších témat. Bez dovedností a znalostí získaných v předmětu Vyjednávání a mediace I je absolvování kurzu Mediation as Dispute Resolution prakticky nemožné, neboť se výuka nevrací k základům mediace a vyjednávání a předpokládá jejich aktivní zvládnutí.
