English

.The course provides an overview of the basic concepts of sovereignty in modern political and legal philosophy. The participants will elaborate on theoretical foundations of "classical" conceptions of sovereignty from J. Bodin, T. Hobbes and to Hegel, constitutional positivism and the concepts of sovereignty in Carl Schmitt and H. Heller. At the same time, critical views on the "discourse of sovereignty" by proponents of pre-modern jusnaturalism and sociological pluralism, normativism, structuralism, and radical-democratic thinking will be presented. The course will focus on different perspectives on the relationship between the concepts of sovereignty, law, state and people and the development of discussions about this relationship. The course will also discuss in more detail the methodological differences in the approach to the studied topic from the perspective of political theory as a political science field, political science as a legal field and (political) philosophy.

Kurz poskytuje přehled základních konceptů suverenity v moderní politické a právní filosofii. Budou v něm představeny teoretické fundamenty „klasických“ pojetí suverenity od J. Bodina, T. Hobbese a po Hegela, státoprávní pozitivismus a pojetí suverenity u Carla Schmitta a H. Hellera. Zároveň s nimi budou představeny i kritické pohledy na „diskurs suverenity“ jak ze strany zastánců předmoderního jusnaturalismu, tak i sociologického pluralismu, normativismu a strukturalismu a radikálně-demokratického myšlení. Kurz se bude zaměřovat na různé pohledy na vztah mezi pojmy suverenity, práva, státu a lidu a vývoj diskusí o tomto vztahu. V kurzu budou blíže rozebrány i metodologické odlišnosti v přístupu ke studovanému tématu z perspektivy politické teorie coby politologického oboru, státovědy coby právního oboru a (politické) filosofie.
