Preliminary scope of work
Hlavní náplní práce je podrobně rozebrat problematiku průlomů do bankovního tajemství výslovně neupravených v zákoně, ale dovozených výkladem ze strany ČNB anebo judikaturou soudů na jednotlivých případech z bankovní praxe, jako je kupříkladu postoupení pohledávky, outsourcing atd. Sekundární náplní práce je komplexně popsat právní úpravu bankovního tajemství a průlomů do něj tak, jak vyplývá ze zákona, výkladu ze strany ČNB, judikatury soudů a právní doktríny. Práce by se měla také pokusit zhodnotit právní úpravu bankovního tajemství a průlomů do něj a v návaznosti na to diskutovat některé úvahy a návrhy de lege ferenda.
Preliminary scope of work in English
The main content of the thesis is to analyze in detail the issue of the exceptions to banking secrecy not expressly provided for by the laws, but inferred by the interpretation of the Czech National Bank or by court decisions, on individual cases from banking practice such as assignment of a claim against a client, outsourcing, etc. Furthermore, the thesis should provide a comprehensive description of the legal regulation of banking secrecy and exceptions thereto arising from the statutes, the interpretation given by the CNB, court decisions, and legal doctrine. The thesis should also attempt to evaluate the statutory regulation of banking secrecy and exceptions thereto and in connection to that discuss some of the de lege ferenda reflections and propositions.
