Preliminary scope of work
Tato diplomová práce se zabývá Ústavou Pylypa Orlyka z roku 1710. Cílem práce je popsat a analyzovat tento právní dokument a uvést jej do historického kontextu doby před jejím vznikem a v době vzniku. Kromě samotné Ústavy Pylypa Orlyka je cílem této práce stručně popsat i teorii dělby moci a smluvní teorii, které úzce souvisí se samotnou ústavou. První část práce se proto věnuje právě těmto teoretickým východiskům, přičemž je nastíněn pohled hlavních myslitelů na společenskou smlouvu a dělbu moci ve státě. Druhá část práce se věnuje historii na ukrajinském území před rokem 1710, a to kvůli pochopení obsahu dokumentu a okolnostem jejího vzniku. V třetí části práce je vymezen prostor pro představení osobnosti Pylypa Orlyka, jeho kariéře a jeho politickému vlivu a myšlení. V další části je rozebrána samotná Ústava Pylypa Orlyka, a to nejdříve její ideové prameny a autoři a dále samotné jednotlivé články ústavy. V předposlední části diplomové práce je pojednáno o Ústavě Pylypa Orlyka v komparaci a benátským státním zřízením a dále v komparaci s polskou májovou ústavou. Na závěr diplomové práce je zařazena úvaha autora nad významem Ústavy Pylypa Orlyka pro další právní vývoj na ukrajinském území.
Preliminary scope of work in English
This diploma thesis deals with the Pylyp Orlyk's Constitution from the year 1710. The aim of this thesis is to analyse this constitutional document within its historical context. The thesis is divided into six parts. The first one is concerned with separation of powers and contract theory. The thesis investigates ideas of the main philosophers connected to those theories. The second part deals with the Ukrainian history before the year 1710 so that the thesis can deliver context of Pylyp Orlyk’s Constitution. The third part looks into the life of Pylyp Orlyk himself. It analysis his career, ideas and his way towards leadership. The next part deals with the Pylyp Orlyk’s Constitution itself, mainly its origin, authors, and context. It also describes articles of this constitution. The fifth part of this thesis compares Pylyp Orlyk’s Constitution with the Venetian state and The Constitution of 3 May 1791, which was a polish constitution. The last part of this thesis summarizes the influence of Pylyp Orlyk’s Constitution for the legal development on Ukrainian territory.
