| Preliminary scope of work |
| Rigorózní práce pojednává o dvou právních ?formách? zajištění bytových potřeb. Jsou jimi družstevní bydlení a institut společenství vlastníků jednotek. Rigorózní práce zcela záměrně zahrnuje pouze úvahy o vybraných dvou formách. Text práce se bude členit do několika celků ? v prvé řadě zmapování vývoje právní úpravy obou institutů, neboť kořeny právní úpravy a historické souvislosti mají v této oblasti značný vliv na současnou právní úpravu a její pojetí. Dále následuje popis a úvahy nad povahou obou subjektů práva a rozbor základních institutů, včetně výkladové praxe soudů České republiky.
Převažující metodou je metoda komparace, která umožňuje zkoumat oba instituty souběžně a porovnávat je dle vybraných a předem stanovených kritérií. Cílem rigorózní práce je rozebrat aktuální právní úpravu s ohledem na vývoj družstevnictví v historii českých zemí a srovnat s právní úpravou společenství vlastníků jednotek. |
| Preliminary scope of work in English |
| This thesis deals with two legal forms of housing. These are residential cooperatives and unit owners´ associations. The thesis deals with these two forms advisedly. The text will be divided into several parts - at first the historical process of both forms because it´s routes influent the contemporary legal framework, the description and the analysis of both forms, the analysis of basic topics with implemented decisions of czech courts.
The main method is the comparative method which is very proper and it shows points of views how to compare these two topics. The intention of the thesis is to analyse and compare the contemporary legal framework of residential cooperatives with unit owners´ associations. |
