Preliminary scope of work

Tato práce si klade za cíl komplexní obraz o intersexualitě v Německu od devadesátých let minulého století, kdy se začínají objevovat intenzivnější debaty o jejím postavení s důrazem na změnu jejího statutu po listopadu 2013. Na základě veřejných diskusí a vyjádření odborníků (zejména lékařů, právníků a politiků) rovněž představí jednotlivé názorové proudy, jež se objevovaly ještě před novely občanského zákoníku týkající se "třetího pohlaví" a které mimo jiné naznačují možná budoucí rizika plynoucí z této legislativní změny. Náplní práce je dále vyzdvihnout nejdůležitější argumenty a požadavky objevující se v těchto diskusích - zákaz genitálních operací u malých dětí a zachování práva na sebeurčení. Zajímavé je také sledovat, jaké z těchto argumentů se nakonec skutečně promítly do odhlasované novely v roce 2013.

Preliminary scope of work in English

The main aim of this diploma thesis is to give a comprehensive picture of the intersexuality in Germany since the 1990s, when the intense debate about this topic first emerged with an emphasis on the change its status after November 2013. On the basis of public discussions and expert opinion (especially doctors, lawyers and politicians) i would like to present the divers opinions, which appeared before the enactment of "third sex", among other things, indicating potential future disadvantages arising from this legislative change. The other aim is also to highlight the most important arguments and requirements emerging in these discussions - a ban on genital surgery on young children and the preservation of the right to self-determination. It is also interesting to see what of these arguments are ultimately reflected in the amendment to the Civil Code in 2013.
