Preliminary scope of work

Cílem této diplomové práce je vysvětlení litery a aplikace článku 8 Evropské úmluvy o ochraně lidských práv a základních svobod z pohledu Evropského soudu pro lidská práva. Diplomová práce se zabývá především problematikou týkající se práva dítěte znát svůj původ a informace o svém raném dětství. Zejména se snaží nastínit, jakým způsobem Evropský soud pro lidská práva vnímá a řeší střet práva dítěte znát svůj původ s právem rodiče na zachování identity. Diplomová práce je členěna do pěti kapitol, na kterých lze objasnit jednotlivé aspekty aplikace článku 8 Úmluvy. Kapitoly jsou propojeny zejména pomocí rozsudků Gaskin, Mikulić, Odiévre, Jäggi a Phinirikadou, které se týkají práva dítěte znát svůj původ.

Preliminary scope of work in English

The aim of the thesis is to explain wording and application of the Article 8 of the European Convention for the Protection of Human Rights and Fundamental Freedoms from the perspective of the European Court of Human Rights. The thesis especially deals with the issue of the right of the child to know his/her origin and information about his/her early childhood. In particular it attempts to outline the way how the European Court of Human Rights deals with the conflict of the right to know one’s origin with the right of the parent to stay anonymous. The thesis is divided into five chapters which illustrate the particular aspects of the application of Article 8. Chapters are linked through the judgements Gaskin, Mikulić, Odiévre, Jäggi and Phinirikadou which are related to the right of the child to know his/her origin.
