Guidelines

Cílem práce je na základě komplexní analýzy teoretické reflexe a praktického fungování obstrukcí v Senátu USA, zvaných filibusters, zhodnotit, zda existence takového formy obstrukčního mechanismu narušuje efektivní fungování Senátu Spojených států amerických, potažmo celého politického systému, a zda v takové formě, v jaké je dnes využíván, neodporuje principům, na kterých byl Senát, respektive Kongres v rámci ústavního systému zkonstruován. Hypotéza je postulována následovně: Filibuster ve své dnešní podobě neplní zamýšlenou funkci demokratické pojistky a reálně narušuje efektivní fungování Senátu Spojených států amerických natolik, že je nutné reformovat Standing Rules of the Senate.
V rámci práce bude využit empiricko-analytický přístup, prostřednictvím studia primárních dokumentů, odborné literatury a internetových zdrojů bude analyzována dosavadní akademická diskuse a vliv filibusteru jakožto parlamentního mechanismu na dynamiku legislativního procesu a na proces vládnutí v USA obecně. Bude proveden i pokus o zmapování teoretického ukotvení filibusteru jakožto parlamentního obstrukčního mechanismu.
