Preliminary scope of work
Tématem práce je společná havárie, konkrétně vznik a vývoj institutu společné havárie, vliv specifických podmínek a okolností námořní plavby na proces rozvoje tohoto institutu mezinárodního, resp. námořního a mořského práva z pohledu námořní praxe a vývoj jejích právních úprav; Práce analyzuje okolnosti a proces vzniku a postupného vývoje institutu společné havárie, interpoluje pravděpodobné podstatné skutečnosti a souvislosti ovlivňující tento proces. Z hlediska mezinárodního práva soukromého a námořního práva jsou hodnoceny krom shora uvedeného i související problémy mezinárodněprávního charakteru, jako je určení příslušnosti justičních orgánů, určení adresátů norem, harmonizace norem a metody realizace záměrů zákonodárců. Recentní česká právní úprava je stručně analyzována z teoreticko právního hlediska a dále je konstatován její vývoj a návaznost na právní řád Rakousko-Uherska. Ze základních historických pramenů práva společné havárie jsou stručně popsány Rhodský námořní zákon, Digesty, Basilika, Ordinamenta di Trani, Tabula Amalfitana, Ordre de Jerusalem a konečně Chartre de Oléron.

General Average, its origin and development within the context of seamanship and navigation
Rigorous thesis focuses on General Average and above all, putting its origin and evolution to context of legal history and theory, understanding its elements both from Seamanship and Law point of view, and/or procedures of navigations participants. The thesis also evaluates probable circumstances of General Average emergence and development from perspective of International Private Law. Thesis analyses conditions and circumstances of General Average historical emergence, interpolates relevant and essential facts involving it. Furthermore the thesis puts to context essential issues of international law, court procedures, jurisdiction, methods and measures implementing objects of legislator. Recent czech codification is theoreticallyanalysed and relation to Austro-Hungarian body of Laws is represented. Sea Laws, Digesta, Ordinamenta and other codifications are collated.
