Preliminary scope of work
Cílem této práce je analýza vztahu lidských práv a ochrany životního prostředí v souvislosti s právem člověka na životní prostředí určité kvality. První kapitola se zaměřuje na teoretické základy problematiky, především na vztah oborů mezinárodní ochrany životního prostředí a lidských práv. V druhé kapitole je rozebrána současná úprava těchto práv v mezinárodních dokumentech hard law i soft law na univerzální úrovni s přesahem do úpravy v rámci dokumentů regionální povahy.Třetí kapitola pak podrobněji rozebírá aktuální judikaturu Evropského soudu pro lidská práva v této oblasti. V závěru pak autor zhodnocuje vhodnost jednotlivých přístupů k ochraně životního prostředí prostřednictvím lidských práv a možnosti dalšího vývoje tohoto tématu.
Preliminary scope of work in English
The aim of this diploma thesis is the analysis of the connection between the protection of human rights to environment of the certain quality and the protection of the environment itself.The aim of this diploma thesis is the analysis of the connection between the protection of human rights to environment of the certain quality and the protection of the environment itself. The first chapter is focused on theoretical basis of the topic, especially the relation between two areas of law – international environmental law and human rights law. The second chapter outlines the evolution of these rights in the hard law and soft law universal international agreements with the overlap into the regional systems of human rights protection. The third chapter analyzes the case law of the European Court of Human Rights in detail.In conclusion, the author evaluates the appropriateness of different human-rights based approaches to the protection of the environment and possibilities of further development of this topic.
