| Tato diplomová práce popisuje a analyzuje právní úpravu místního šetření, které je prováděno Úřadem pro ochranu hospodářské soutěže a Evropskou komisí. Soutěžní úřady jsou oprávněny prošetřovat obchodní a jiné prostory za účelem nalezení informací, které prokazují porušení soutěžního práva. Místní šetření neboli také tzv. dawn raid je nejefektivnější vyšetřovací pravomocí soutěžních úřadů v rámci řízení ve věcech porušení soutěžního práva.
Hlavním cílem této práce je poskytnout detailní popis relevantních zákonných pravidel a související judikatury, upozornit na možné právní problémy související s místním šetřením a nabídnout jejich řešení, a konečně se také věnovat ochraně a zárukám základních práv poskytovaných podnikům v průběhu šetření. Tato diplomová práce se skládá z osmi kapitol. První a druhá kapitola jsou úvodními kapitolami a popisují základní pojmy spojené s právem hospodářské soutěže. Ve třetí kapitole jsou popsány české a unijní právní předpisy upravující místní šetření. Kapitola čtvrtá se zabývá zárukami základních práv šetřených podniků v rámci místního šetření. Kapitola pátá stručně pojednává o spolupráci mezi Komisí a vnitrostátními orgány pro hospodářskou soutěž při provádění šetření. Šestá kapitola je zaměřena na konkrétní pravomoci soutěžních orgánů. Nakonec kapitola sedmá popisuje typický průběh kontroly s důrazem na specifické problémy, které se mohou v průběhu inspekce vyskytnout. Závěry diplomové práce jsou shrnuty v kapitole osmé. |
| Preliminary scope of work in English |
| The Master’s thesis describes and analyses the legislation of the on-site inspections conducted by the Czech Office for the Protection of Competition and the European Commission. The competition authorities may investigate business and other premises in order to find evidence proving the violation of competition rules. The on-site inspection or so called dawn raid is a main investigative and the most effective tool of the competition authorities in proceedings concerning the possible breach of competition law.
The main aim of this thesis is to provide a detailed description of the relevant legislation and case law, to highlight any legal issues connected with on-site inspections and offer solutions of these issues, and finally to examine guarantees of the fundamental rights of the undertakings during the inspection. The thesis consists of eight chapters. Chapter One and Two are introductory and describe basic terms connected with the competition law. In Chapter Three the thesis deals with the scope of relevant Czech and EU legislation. Chapter Four is concerned with the guarantees of fundamental rights within on-site inspections. Chapter Five briefly discusses the cooperation between Commission and national competition authorities during inspections. Chapter Six is focused on particular competences of the competition authorities. Finally Chapter Seven describes typical course of the inspection with emphasis on specific issues that may arise during the inspection. The conclusions of the thesis are drawn in the Chapter Eight. |
