Preliminary scope of work
Jako téma své rigorózní práce jsem si zvolila problematiku smluv, které jsou uzavírány mezi subjekty v IT oblasti. Cíl této práce spočívá zejména v posouzení platné právní úpravy institutů, jež jsou hojně využívány v oblasti uzavírání IT smluv. Práce má odpovědět na otázku, které instituty jsou stěžejní z pohledu zhotovitele, které naopak z pohledu objednatele a současně uvést i pravidelné náležitosti smluv oblasti IT. Co se týče struktury práce, ta je rozdělena na několik kapitol, kdy úvodní kapitoly této práce (spolu s kapitolou závěrečnou) seznamují čtenáře s tématy, jež jsou nutné pro pochopení další problematiky. Tyto kapitoly nutno brát pouze jako nezbytný úvod či můstek k tématům, které považuji za stěžejní, k tématům, které tvoří gro této práce. Témata, která tvoří gro této práce spatřuji v komplexní úpravě problematiky IT smluv. Problematika IT smluv mnou zde uvedená a popsaná umožňuje dle mého názoru celkem celistvý průřez v této práci popsanými instituty s uvedením pádných důvodů, proč a za jakých situacích je třeba je využít a pro jakou smluvní stranu jsou zejména výhodné. Za největší přínos této práce spolu s mým pokusem o pohled na věc vedený snahou o pokud možno reálnou využitelnost této práce v praxi považuji současně i mé příklady možné smluvní úpravy, jež jsou v textu této práce zvýrazněny kurzívou.
Preliminary scope of work in English
I chose as the topic of my thesis the issue of contracts which are concluded between parties in the IT field. The aim of this thesis is mainly in the assessment of current legislation of institutes, which are widely used in the field of IT contracts conclusion. This thesis has to answer the question which institutes are crucial from the perspective of the contractor, which from the perspective of the customer. This thesis has to mention also regular requirements of contract in the field of IT. Regarding the structure of this thesis, which is divided into several chapters, the first chapters of this thesis (along with the final chapter) inform readers about the issues that are important for understanding other issues. These chapters should be taken only as a necessary introduction on topics that I consider essential, the themes of which are key or crucial part of this work. The crucial topic of this work is according to my opinion all-embracing summary of IT contract issue. The issue of IT contracts described in this thesis provides, in my opinion, total integral cross section of described institutes together with stating valid reasons why and in which situations these institutes should be used and for which contractual party these institutes are particularly advantageous. The greatest contribution of this thesis together with my attempt of realistic view driven by a possible usefulness of this work in practical life is my examples to contractual arrangements. Mentioned examples are in the text of the thesis written in italics.
