Kriminologické aspekty kriminální recidivy

Tématem této diplomové práce jsou kriminologické aspekty kriminální recidivy. Autorovou snahou je podat co nejúplnější nástin některých základních myšlenek souvisejících s konceptem kriminální recidivy a seznámit tak čtenáře s jejími vybranými kriminologickými aspekty. Tato práce je rozdělena do čtyř kapitol. Úvodní kapitola se věnuje samotnému pojmu kriminální recidivy a podobně vymezuje její jednotlivá pojetí s důrazem na legální aspekty. Základem této kapitoly je snaha o podrobnější popsání jednotlivých forem v TZ 1961 a také v úpravě de lege lata. Druhá kapitola se zabývá osobností pachatele recidivisty z pohledu vybraných typologií a jsou zde pokládány dvě základní otázky, a sice zda a jak se liší pachatel recidivista od pachatele nerecidivisty a zda se pachatel obecně odlišuje od jedinců respektujících právní normy. Třetí kapitola je zaměřena na koncept kriminální kariéry s důrazem na typologii osobnosti pachatele z hlediska intenzity kriminálního chování. Dále jsou zde předkládány vybrané kriminologické teorie ovlivněné paradigmatem kriminální kariéry. V závěrečné kapitole se autor podrobněji zabývá stavem a vývojem recidivy na území ČR a jeho snahou je nastínit stav a vývoj tohoto institutu především ve dvou časových obdobích. První je charakterizováno poměrně dlouhým a nepřerušeným obdobím získávání statistických údajů a druhé zatím pouze relativně krátkou dobou shromažďování statistických dat související s přijetím současného trestního kodexu.

Criminological aspects of criminal recidivism

The topic of this thesis are the criminological aspects of criminal recidivism and goal is to present a complete outline of some of the basic ideas related to the concept of criminal recidivism and to introduce the reader to its selected criminological aspects. This thesis is divided into four chapters. The introductory chapter is focused on the concept of criminal recidivism itself, and similarly defines the various concepts with emphasis on the legal aspects. The basis of this chapter is the effort to achieve a more detailed description of the various forms in the Penal Code of 1961 and also in modifying de lege lata. The second chapter deals with personality of recidivist offender from the perspective of selected typologies and two fundamental questions are considered, namely whether and how recidivist offender differs from non-recidivist offender and whether the offender is commonly distinguished from individuals who are respecting the law. Third chapter focuses on the concept of criminal careers with an emphasis on the personal typology of the offender in terms of the intensity of criminal behavior. Furthermore there are presented selected criminological theories influenced by the paradigm of a criminal career. In the final chapter of the thesis is dealt with the situation and development of recidivism in the Czech Republic. Effort of this thesis is to outline the status and development of this institute mainly in two time periods. The first is characterized by a relatively long and uninterrupted period of collecting statistics and the second with so far only a relatively short period of collecting statistical data related to the adoption of the current Penal Code.
