Preliminary scope of work
Blankosměnka je institutem v praxi poměrně často užívaným, přesto vzbuzuje řadu otázek pramenících zejména z její kusé zákonné úpravy. Cílem mé práce je především celkově prozkoumat související problematiku, konfrontovat rozporné názory teoretiků, zabývat se nesouladem mezi závěry soudů a teorie, pro případ, že takové naleznu a u sporných oblastí přidat vlastní stanovisko. Výsledkem by pak mělo být komplexní představení blankosměnky včetně výhod a nebezpečí, které tento zcela jistě zajímavý institut v sobě skrývá.
Preliminary scope of work in English
Blank Bill of Exchange is an institution in practice quite often used, but which raises a number of issues stemming mainly from its fragmentary legislation. The aim of my work is primarily to explore related issues, to confront conflicting views of theorists, to deal with the mismatch between theory and conclusions of the courts and in a case I find such to add my own opinion in a contentious area. The result should be a comprehensive presentation of Blank Bill including the benefits and risks which this certainly interesting institute holds.
