V době, kdy syndrom CAN vznikl, byl odpovědí na volání společnosti a odborné veřejnosti po pojmenování základních forem ohrožení pro dítě. Tedy fyzického týrání, zanedbávání a zneužívání. V dnešní době jsou děti vystavovány situacím, které tvůrci syndromu CAN neznaly nebo nereflektovaly. Z historického vývoje vzniku pojmu syndromu CAN můžeme dovodit, že měl původně plnit funkci, kterou v této práci nese pojem ohrožené dítě. Tedy popisovat situace, které mohou vést k negativním důsledkům na harmonický fyzický, psychický a morální vývoj dítěte. V dnešní době už tuto funkci plnit nemůže.
Předkládaná práce si klade za cíl poukázat a řešit teoretické problémy, které pramení z mnohoznačného významu pojmu ohrožené dítě tak, aby se mohly stát východiskem vhodné a efektivní právní úpravy. Chceme poukázat na přetrvávající problémy, na které v teoretické rovině reagují na stereotypní strategie a praxi činí neefektivní. Pokud totiž nejsme schopni jasně říci, jaké dětí tvoří kategorii ohrožené, pak nemůže být jejich ochrana efektivní, protože nevíme, koho vlastně chráníme a koho bychom měli chránit. V takové situaci nám nepomůže ani sebelepší právní úprava, ani žádný nový institut nebo orgán chránící děti. |
Preliminary scope of work in English |
At the time the CAN syndrome was created, it was a response to the call from society and the professional community to name the basic forms of threat to the child. That is, physical abuse, neglect and exploitation. Nowadays, children are exposed to situations that the creators of the CAN syndrome did not know or reflect. From the historical development of the term CAN syndrome, we can infer that it was originally intended to serve the function that the term child at risk carries in this thesis. That is, to describe situations that can lead to negative consequences for the harmonious physical, psychological and moral development of the child. Nowadays, it can no longer fulfil this function. The present work aims to point out and solve the theoretical problems that arise from the ambiguous meaning of the concept of a child at risk so that they can become the basis for appropriate and effective legislation. We want to point out the persistent problems that, at the theoretical level, respond to stereotypical strategies and render practice ineffective. Indeed, if we are unable to say clearly what children constitute the category of those at risk, then their protection cannot be effective because we do not know who we are actually protecting and who we should be protecting. In such a situation, neither the best legislation nor any new institution or body protecting children can help us. |
