Preliminary scope of work

Tato diplomová práce představuje komplexní rámcový návrh zákona o legalizaci prostituce v České republice, přičemž je psána formou analýzy dopadů regulace (RIA). Navrhovaná právní úprava si klade za cíl odstranit nedostatky současného abolicionistického přístupu, který prostituci nijak nereguluje a netrestá ty, kteří se jí věnují. Současný stav ovšem vytlačil prostituci do šedé ekonomiky a znemožnil účinnou kontrolu a monitoring ze strany státu. Navrhovaný rámcový zákon, si tedy klade za cíl tyto obavy řešit vytvořením jasného legislativního rámce, který posílí státní kontrolu, zvýší transparentnost na trhu sexuálních služeb, sníží společenské náklady a zlepší existenční podmínky pro sexuální pracovníky samotné.
Navrhovaný rámcový zákon je rozdělen do jedenácti samostatných částí, z nichž každá obsahuje několik možných řešení, která jsou analyzována prostřednictvím multikriteriální analýzy (MCA). Tato analýza vychází z důkladného zkoumání stávajících zákonů, dřívějších návrhů zákona, odborné literatury a zavedené praxe v jiných státech. MCA dává větší váhu regulačním cílům odvozeným z kvantitativního dotazníkového šetření, konaného v rámci České republiky. Hlavními hodnotícími kritérii je minimalizace sociálních, ekonomických a zdravotních dopadů jednotlivých legislativních variant.
Konečný rámcový zákon sestavený z vybraných dílčích variant ke každé z jedenácti samostatných částí je následně podroben základní analýze nákladů a přínosů (CBA). Cílem navrhovaného rámcového zákona je zajistit práva sexuálních pracovníků, definovat jasné podmínky fungování prostituce na území ČR a zavést účinné strategie monitorování a vymáhání práva v této oblasti. Kromě toho má zákon za cíl posílit ochranu veřejného zdraví a destigmatizovat prostituci.
Cílem této studie je oživit veřejnou diskusi o legalizaci prostituce s nadějí, že navrhovaný právní rámec poslouží jako katalyzátor budoucích reforem jak v rámci České republiky.

Preliminary scope of work in English

This thesis proposes a comprehensive framework law for legislation that would legalize prostitution in the Czech Republic. The thesis is structured as a Regulatory Impact Assement (RIA). The proposed legislation aims to address the shortcomings of the current abolitionist approach, which does not regulate prostitution and does not punish those who engage in it. However, this approach has resulted in the pushing of prostitution into the informal economy and has made effective control and monitoring by the state impossible. The proposed framework law aims to address these concerns by creating a clear legislative framework that will strengthen state control, increase transparency in the sex market, reduce social costs, and improve the livelihoods of sex workers.
The proposed framework law is divided into eleven separate parts, each containing several possible solutions, which are analyzed through a multi-criteria analysis (MCA). This analysis is based on thoroughly examining existing laws, previous bills, expert literature, and established practices in other jurisdictions. The MCA assigns greater weight to regulatory objectives derived from a quantitative survey conducted within the country. The primary evaluation criteria are designed to minimize the social, economic, and health impacts of each sub-variant.
The final framework law, which is derived from selected sub-variants for each of the eleven separate parts, is then subjected to a simple cost-benefit analysis (CBA). The proposed framework law aims to ensure the rights of sex workers, to define clear conditions for the operation of prostitution in the Czech Republic, and to introduce effective monitoring and enforcement strategies in this area. Additionally, the framework of law aspires to fortify public health protection and reduce the social stigma associated with prostitution.
The objective of this study is to reinvigorate the public discourse surrounding the legalization of prostitution. It is hypothesized that the proposed framework law will serve as a catalyst for future reforms in the Czech Republic.
