Práce se snaží identifikovat hlavní sporné otázky pojící se s institutem digitální pozůstalosti, přinést nové pohledy do rozbíhající se doktrinální debaty a na většinu vyřčených otázek se pokouší najít odpověď. Za tím účelem navzájem konfrontuje existující pohledy tuzemské i zahraniční právní vědy i praxe a zejména se snaží prokázat roli obecných principů v právu. Hlavní tezí je zjistit, zda se tradiční právní principy ukáží jako nadčasové i pro virtuální aktiva.
Preliminary scope of work in English
The paper tries to identify the main controversial questions related to the institute of digital legacy, to bring new perspectives to the unfolding doctrinal debate, and to find answers to most of the stated questions. For this purpose, it confronts the existing views of domestic and foreign jurisprudence and practice and, in particular, tries to demonstrate the role of general principles in law. The main thesis is to find out whether traditional legal principles will prove to be timeless even for virtual assets.
