Preliminary scope of work in English
This study will focus on the issues connected with the protection of freedom of assembly and association under the ECHR and ICCPR in the Russian Federation. The right of expressing an opinion and public disagreement with the authorities is one of the unalienable rights, which people all over the world should possess. States take upon themselves obligations of implementing the international conventions (in this particular thesis the focus of attention is on the Convention for the Protection of Human Rights and Fundamental Freedoms and International Covenant on Civil and Political Rights, which ensure the freedom of assembly and association and create a legal basis for the states to follow) and adduce in their domestic legal systems. Although Russian Federation, according to its Constitution, is a democratic state and has ratified ECHR and ICCPR, it has been on multiple occasions accused of violating the freedom of association of its citizens. Russian domestic legislation, however in compliance with Article 11 of ECHR (Freedom of assembly and association) and Articles 21 and 22 of ICCPR it might seem, presents a number of ways how the ultimate right of assembly and association can be limited or abused altogether. The reasons behind violations are being analyzed, specifically the political ones. The topic presents particular political, judicial, and social relevance taking into account the significance of the Russian Federation as an actor of international relations, its influence on the system generally, and neighboring countries (such as Belorussia and Ukraine, for example) in particular. Violations of international standards of the protection of human rights by such influential players might cause negative consequences not only for the citizens of the given country but also for the whole international community fighting to provide democratic rights and freedoms. It is vital to pay attention to implementation and possible violations of ECHR and ICCPR regulation and determine the extent and reasoning behind them.
