Preliminary scope of work

Cílem této práce je analyzovat vývoj právní úpravy dědického práva na našem území přibližně od vzniku první Československé republiky do současnosti s ohledem na omezení autonomie vůle zůstavitele. V úvodních kapitolách jsou shrnuty základní zásady dědického práva a možné projevy autonomie vůle zůstavitele. Následně je podáno pojednání o autonomii vůle zůstavitele podle ABGB, středního občanského zákoníku, různých znění občanského zákoníku a nového občanského zákoníku z roku 2012.

Preliminary scope of work in English

The goal of this thesis is to analyse the autonomy of testator’s will in the development of Czech law of inheritance from the first Czechoslovakian Republic until present. In the first chapters there are summarized basic legal principles of the law of inheritance and possible ways, how the testator can express his will. The next part of the paper deals with the legal regulation of the key institutes in ABGB, middle civil code, different versions of the current civil code and finally the new civil code from 2012.
