Tato diplomová práce je psaná na téma metodika vyšetřování vražd. Zabývá se především postupem policejního orgánu při vyšetřování trestného činu vraždy. Jelikož se jedná o velice rozsáhlé téma a součástí metodiky je velké množství úkonů, věnovala jsem se pouze vybraným okruhům. Obsahem první kapitoly je specifikace trestných činů proti životu, zejména pak jejich právní úprava a právní aspekty. Zaměřila jsem se na právní úpravu v českém právním řadu trestného činu vraždy, zabití a vraždy novorozeného dítěte matkou, ale okrajově jsem též zmínila trestný čin usmrcení z nedbalosti a trestný čin účasti na sebevraždě. V druhé kapitole uvádím statistiku spáchaných vražd. Analyzuji statistiku počtu spáchaných vražd v rámci Evropské unie, České republiky a Ústeckého kraje. Další část je charakteristická teoretickou částí, ve které se zabývám kriminalistickou charakteristikou trestného činu vraždy. Zaobírám se jednotlivými aspekty – způsob páchání, osobnost pachatele, osobnost oběti a motiv. Následující kapitola je stěžejní částí této práce, kde se věnuji typickým vyšetřovacím situacím, především shrnuji počáteční úkony. Detailně se zaměřuji na úkony, kterými jsou výslech oznamovatele trestného činu a osob zemřelé osobě blízkých, rekognice mrtvoly, ohledání místa činu a těla mrtvoly. Práce je navíc obohacena o kazuistiku získanou ze soudních spisů.

This diploma thesis is devoted to the investigation methodology of murders. The main emphasis is given to the procedure of the police authority within the investigation of murders. Since this topic is very extensive and the methodology comprises of the great amount of activities, I dedicate this diploma thesis only to the selected areas thereof.
The first chapter describes the specification of the crimes against life, in particular legal regulation and related aspects. I focused on the legal regulation in Czech law with respect to a crime of murder, homicide and murder of a new born by its mother. Only marginal attention is given to a crime of negligent manslaughter and a crime of assisting with suicide. The second chapter comprises of the statistics of the committed murders. I analyse the statistics of the numbers of murders committed within the European Union, the Czech Republic and the Ústí region. Another part of the thesis is theoretically orientated. I concentrate on the criminalistics characteristic of a murder and the fundamental aspects thereof – the mode of committing a crime, the personality of a murderer, the personality of a victim and a criminal motive. The following chapter forms the crucial part the diploma thesis in which I analyse typical investigation situations, in particular in relation to the initial activities. I aim the attention in detail to the activities of the interrogation of a person who notifies a crime, the interrogation of the persons related to the deceased, the recognition of a dead body, the site inspection and the autopsy. The diploma thesis is enriched with the cases history which have been gained upon research from the court files.
