Práce se zaobírá vztahem mezi Hobbesovým a Pufendorfovým konceptem suverenity, a to s přihlédnutím k recentní literatuře zabývající se "klasickými" teoriemi suverenity. Hlavní důraz je kladen zejména na korelaci mezi pojmem suverenity a fiktivní, resp. morální osoby. Oproti časté zjednodušené interpretaci se totiž Hobbesovo i Pufendorfovo pojetí suverenity neváže k empirické sféře, nýbrž k imaginativní, artificiální sféře empiricky nepřítomných entit. Suverenitu zde nelze zaměňovat za empirickou moc, resp. za nejvyšší autoritu v rámci konstituovaného systému, jak byla chápaná středověká potestas absoluta. Takto abstraktně pojatá moc, jež se vztahuje k lidu jako celku, však také nemůže být popřena, jak tvrdí řada současných autorů, pouhým empirickým faktem fakticky omezené moci států či globalizací a nadnárodní integrací. Hobbesův a Pufendorfův pojem suverenity tak nemusí ztrácet svou relevanci ani v současném světě.
Preliminary scope of work in English
The work deals with the relationship between Hobbes's and Pufendorf's concept of sovereignty, taking into account the recent literature dealing with the "classical" theories of sovereignty. The emphasis is given to the correlation between the concept of sovereignty and the fictitious (imaginary) or moral person. In contrast to the often simplified interpretation of Hobbes, his and Pufendorf's concept of sovereignty does not relate to the empirical sphere, but to the imaginative, artificial sphere of empirically absent entities. Therefore, sovereignty should not be confused with the empirical power or with the highest authority of a legal order, as it was understood in medieval potestas absolute. Sovereignty as an abstractly conceived power, which refers to the people as a whole, can not be thus denied, as it is claimed by many contemporary authors, by the mere empirical fact of de facto limited power of the state and by globalization and supranationalization. Hobbes's and Pufendorf's concept of sovereignty so do not lose their relevance even in today's world.
